Terms of service
Effective
1. Who we are and what these terms cover
Crewcade is operated by Jesse Alvarado, a sole proprietor based in Japan. Crewcade is not incorporated. "Crewcade", "we" and "us" mean that operator. Contact: [email protected]. We publish no postal address. We disclose it without delay when you ask by email.
These terms cover crewcade.com, the Crewcade web app, and the club sites and sign-up pages that run on Crewcade (together, the "Service"). By creating an account or using the Service, you accept these terms and our Privacy policy. If you do not accept them, do not use the Service.
You may use the Service for a club or business only if you can bind it to these terms. If you act for a club, "you" includes the club.
2. How Crewcade works
Crewcade is membership and event software for clubs, schools and community groups. A club (a "host") sets up a workspace. People (members, guests and visitors) join the workspace, register for events and pay the club.
- One account, many clubs. You sign up once. The same account can join any club on Crewcade. An account alone makes you a member of nothing. Joining is a separate step with each club.
- Workspaces are separate. A club's members, content and settings live in its own workspace. Your account details (email, password, basic profile) are managed by Crewcade.
- Clubs set their own rules. A club can add terms, rules and prices. You follow them when you join. If a club's rules conflict with these terms, the club's rules govern inside that club. These terms govern your Crewcade account and anything between you and Crewcade.
- Crewcade is a platform. We do not run the clubs. We are not a party to the sale between a club and its members, and we do not control what hosts offer or publish.
3. Accounts
- You must be at least 13, or the age of digital consent where you live, to open your own account. A parent or guardian may add a younger child to a family membership they manage, and is responsible for the child's use.
- Give accurate information and keep it current.
- Keep your sign-in details private. You are responsible for what happens under your account. Tell us right away if someone else gets in.
- One person or entity keeps one account. Do not share, sell or transfer an account.
- We may require email verification before you use some features.
To close your account or get a copy of your data, email [email protected] from the email on the account. We act within 30 days. Closing an account ends your memberships in every club. A host who owns a workspace deletes it from settings (see section 9).
4. Acceptable use
You agree not to:
- break any law or anyone's rights;
- harass, threaten or impersonate anyone, or misstate who you are or who you represent;
- post illegal, deceptive, hateful or infringing content, or personal data of others without a lawful basis;
- send spam, or send email or messages to people who have not asked for them;
- upload malware, or probe, scan or attack the Service or other accounts;
- scrape or automate the Service in ways we have not approved, or bypass rate limits, bot checks or other controls;
- create accounts to evade a ban or a limit;
- use the Service to sell anything illegal or that Stripe prohibits.
We may screen names and published text with automated tools to find spam and abuse. A flag puts the item in front of a person. We may remove content or suspend accounts that break these rules (see section 12).
5. Content and brand material
You keep ownership of what you add to Crewcade: your brand material, photos, events, posts, pages and member list. The promo and page output Crewcade builds from your material is yours to use anywhere, including after you leave.
You give Crewcade a worldwide, non-exclusive, royalty-free licence to host, copy, process, display and transmit your content, and to make changes needed to run the Service (for example, resizing images, translating pages on your request and making backups). This licence is for running the Service for you. It ends when you delete the content and it leaves our systems, except for backups and legal records that expire on their normal schedule.
You promise you have the rights to what you add, including images and brand material you import from other places. Hosts answer for the content they publish and for the rights to it. A host's branding belongs to that host, not to Crewcade.
Crewcade owns the Service: its code, design, features and trademarks. Do not copy, modify, resell or reverse engineer it, except as the law allows.
To report a copyright problem, email [email protected] with the work, the URL, and how to reach you.
6. Data protection
Our Privacy policy explains the data we handle. In short: Crewcade controls account data. A host controls its members' data, and Crewcade processes it for the host. A host must have a lawful basis to collect and use member data, must tell members what it does with it, and must answer member requests. Crewcade helps with export tools and deletion. This section and the Privacy policy serve as the host's processing terms with Crewcade, unless you and we sign a separate agreement.
7. AI features
Crewcade offers AI tools that draft events, pages, forms, captions and translations, and that make flyer images. Output can be wrong, repeat other work or miss context. You review it before you publish it. You are responsible for what you publish. Do not enter sensitive personal data into an AI feature. The Privacy policy lists which providers receive AI inputs. We may limit AI use to protect the Service from abuse and cost.
8. Plans, fees and payments
Crewcade plans
Hosts choose a plan. Prices, plan limits and the ticket fee for each plan are on our pricing page. That page is part of these terms. Plan features and prices can change. For a paid subscription, a price change reaches you only at your next renewal after we give you at least 30 days' notice.
- Paid plans bill in advance, each month or each year, through Stripe, and renew until cancelled.
- You authorise us to charge your payment method on each renewal.
- You can cancel in your billing settings. The cancellation takes effect at the end of the period you already paid for. Until then your plan stays active.
- If you change plans in the middle of a period, charges are prorated as the billing screen shows before you confirm.
- If a payment fails, we may limit paid features until it is paid.
- Fees are non-refundable except where the law requires a refund, or where a written offer from us at the time of purchase says otherwise.
- Fees exclude taxes. You pay applicable taxes, including Japanese consumption tax where it applies.
Payments from members to a club
- Online ticket and membership payments run through Stripe. A host connects its own Stripe account. The charge settles in that account. The host is the seller and the merchant of record. Crewcade is not.
- For each online ticket sale we collect a platform fee through Stripe. The fee depends on the host's plan and is set out on the pricing page. Stripe's own processing fees are separate and are charged by Stripe to the host's account.
- The host sets prices, refund rules, and answers for refunds, disputes and chargebacks on its sales. Contact the host first. Crewcade provides the tools to issue refunds.
- Hosts must follow Stripe's terms and Stripe Connect rules. Stripe can reject, freeze or close a connected account. We are not liable for Stripe's decisions.
9. Deleting a workspace
The workspace owner can delete the workspace from settings. The delete is immediate and permanent. There is no grace period. We refuse it while live member subscriptions, ticket payments or similar money flows are open, so you can end them first. After deletion, we keep the invoices, plan history and fee records we need for tax and accounting. Those records hold no buyer names, emails or member IDs, but they keep the deleting owner's email and account ID. Export your member list before you delete.
10. Third-party services
The Service connects to services we do not run, such as Stripe, Google, LINE, email and newsletter tools, map providers and AI providers. Their terms apply to your use of them. We are not responsible for them. A host that connects its own account (for example a LINE official account or a newsletter tool) answers for that connection.
11. Availability and changes
We work to keep the Service running, but we do not promise it will be uninterrupted or error-free. We may change, add or remove features. If we end a paid feature or the Service, we give you reasonable notice and a way to export your data.
12. Suspension and termination
You can stop using Crewcade at any time. We may suspend or end your access if you break these terms, if you create risk or harm for others, if we must by law, or if we stop offering the Service. We try to warn you first, except for serious or urgent cases. A host may remove a member from its workspace without affecting the member's other clubs.
After termination your right to use the Service ends. Sections that by nature should survive, including content rights, fees owed, disclaimers, liability limits and governing law, keep applying.
13. Disclaimers
The Service is provided "as is" and "as available". To the extent the law allows, we do not give any warranty, express or implied, including fitness for a purpose, accuracy, and non-infringement. We do not promise the Service meets your needs or that AI output is correct. We are not responsible for what hosts and other users do or publish.
If you are a consumer under the law of your country, some rights cannot be waived. Nothing in these terms limits those rights.
14. Limit of liability
To the extent the law allows, Crewcade is not liable for indirect, incidental, special or consequential loss, or for lost profits, data or business. Our total liability for any claim about the Service is limited to the fees you paid to Crewcade in the 12 months before the event that caused the claim. If you paid us nothing, our liability is limited to 10,000 yen.
This section does not limit liability for our intentional misconduct or gross negligence, or anything that the law says we cannot limit.
15. Your promises to us
You are responsible for your content and your use of the Service. If a third party makes a claim against us because of your content, your breach of these terms or your breach of the law, you will cover our reasonable costs and losses from that claim, to the extent the law allows.
16. Disputes and governing law
Email [email protected] first and give us 30 days to work it out. These terms are governed by the laws of Japan. The Tokyo District Court is the exclusive court of first instance for any dispute about these terms or the Service. If you are a consumer, this does not remove rights that mandatory consumer law of your country gives you.
17. General
- Changes. We may update these terms. We post the new version here with a new effective date. For material changes we also email account holders or show an in-app notice. Using the Service after the effective date means you accept the change. If you do not accept it, stop using the Service.
- Whole agreement. These terms, the Privacy policy, the pricing page and any club rules are the whole agreement between us.
- If part is invalid. The rest stays in force.
- No waiver. If we do not enforce a term, we do not give up the right to enforce it later.
- Assignment. You may not transfer these terms without our consent. We may transfer them in a sale of the Service.
- Events beyond our control. We are not liable for failures caused by events we cannot reasonably control, including outages of internet, hosting or payment providers.
- Language. The English text controls if a translation differs.
